For the use of the learning platform with media under a Creative Commons license, the following special terms of use of the learning platform (hereinafter "User Agreement") apply in addition to the general terms of use of the Planet Bambi - Gisela & Theo Grabowski Foundation website and the applicable Creative Commons terms. Users of the learning platform also have the option of registering to use additional features of the platform (web-based training, learning progress monitoring, newsletter). For this area, please note the regulations under "Registration, Password."

The Planet Bambi - Gisela & Theo Grabowski Foundation provides free digital teaching materials to the general public, especially educational institutions/staff and volunteers in the educational sector, via the learning platform.

2.1 Registration is only necessary to use the additional functions of the learning platform.

2.2 The Planet Bambi - Gisela & Theo Grabowski Foundation reserves the right to revoke your access authorization to the additional functions of the media portal at any time by blocking your account without providing reasons. Blocking will occur, in particular, if you have provided false information during registration, violate this User Agreement or your duty of care in handling your access data, violate applicable law when accessing or using the Planet Bambi - Gisela & Theo Grabowski Foundation learning platform, or have not used the Planet Bambi - Gisela & Theo Grabowski Foundation learning platform for an extended period of time.

2.3 After registration, you will receive a confirmation of your registration on screen, along with your login name and password (hereinafter "Login Data"). The password provided to you by the Planet Bambi - Gisela & Theo Grabowski Foundation should be changed to a password known only to you after logging into your "Personal Area" for the first time.

2.4 You can view and change your access data and other user data, which must be provided during registration, at any time in the “Personal Area”.

2.5 Ensure that you do not make your login credentials accessible to third parties. You are legally responsible for all activities conducted using your login credentials. Therefore, please log out of the platform after each use using the "Logout" button.

2.6 If you become aware that third parties are misusing your access data, you are obligated to notify the Planet Bambi - Gisela & Theo Grabowski Foundation immediately by email. Upon receipt of this notification, the Planet Bambi - Gisela & Theo Grabowski Foundation will block access to the password-protected area using your access data.

2.7 After registration, you can request closure of your account at any time. Please send us your name, address, and email address to the following address: bambigo@planetbambi.foundationWe will then delete your registration and all data stored in your account, unless we are legally obligated to continue storing it; this may be necessary, for example, due to tax regulations. After deletion, the private area of the media portal will no longer be accessible to you.

3.1 Unless otherwise indicated, the media available on the learning platform are subject to the Creative Commons License CC BY-SA, Version 4.0 International. The exact wording of this license can be found at https://creativecommons.org/licenses/by-sa/4.0/legalcode.de.

3.2 The right of use granted to you under a Creative Commons License CC BY-SA, Version 4.0 internationally includes the right to

• share – ie reproduce and distribute the material in any format or medium
  
• edit – ie remix and modify the material for any purpose,
  

provided you comply with the following conditions:

• Attribution – You must provide appropriate credit, link to the license, and indicate if changes were made. This credit may be given in any reasonable manner, but not in a way that suggests the licensor endorses you or your use of the work.
  
• Share Alike — if you remix, modify, or otherwise build directly upon the material, you may only distribute your contributions under the same license as the original.
  
• No further restrictions — You may not add any additional clauses or technological measures that legally prohibit others from doing anything the license permits (summary source: https://creativecommons.org/licenses/by-sa/4.0/deed.de).
  

The details of the usage rights for the media provided via the learning platform are set out in the applicable license terms, which are specified and accessible for each medium.

3.3 Any restrictions on use arising from the License Terms shall not apply to parts of the Material that are in the public domain or to the extent that their use is covered by exceptions and limitations of copyright law.

3.4 The additional information provided for the individual media (metadata such as short info, description, author and copyright information) is also made available to the public internationally under a Creative Commons License CC BY-SA, version 4.0.

3.5 Any misuse of the teaching materials and additional information may result in criminal and civil proceedings.

3.6 At the request of the Siemens Foundation, you are obliged to provide the Siemens Foundation with information about the manner in which you use the teaching materials you have accessed in the media portal.

If software is made available for download via the Planet Bambi - Gisela & Theo Grabowski Foundation learning platform that is subject to a separate license agreement, the software may only be used in accordance with the terms of the associated license agreement. The terms of this user agreement remain unaffected.

5.1 The granting of the rights of use pursuant to Section 3 and all other services by Planet Bambi - Gisela & Theo Grabowski Foundation within the framework of this User Agreement are free of charge.

5.2 The Planet Bambi - Gisela & Theo Grabowski Foundation is only liable in connection with the use of the learning platform and the implementation of this user agreement

• for intent and gross negligence of Planet Bambi - Gisela & Theo Grabowski Foundation, its legal representatives and vicarious agents,
  
• in all other cases in which liability is mandatory under the law, i.e. in particular in the case of injury to life, body and health and under the Product Liability Act.
  
• Any further liability of Planet Bambi - Gisela & Theo Grabowski Foundation is excluded.
  

5.3 Claims for legal and material defects in the media and other services provided by the Planet Bambi - Gisela & Theo Grabowski Foundation as part of the learning platform are excluded, except in cases of fraudulent intent. In particular, the Planet Bambi - Gisela & Theo Grabowski Foundation does not guarantee that the media provided on the learning platform, their content, and the information contained therein are correct, complete, and/or usable.

5.4 The above provisions in clauses 5.2 and 5.3 do not involve a change in the burden of proof to your disadvantage.

5.5 Although the Planet Bambi - Gisela & Theo Grabowski Foundation always strives to keep the learning platform and the media contained therein virus-free, the Planet Bambi - Gisela & Theo Grabowski Foundation does not guarantee virus-free operation. Before downloading media, you are responsible for ensuring appropriate security measures and virus scanning for your own protection and to prevent viruses from infecting the Planet Bambi - Gisela & Theo Grabowski Foundation learning platform.

6.1 German law applies.

6.2 This User Agreement shall remain binding in its remaining parts even if individual provisions are legally invalid.
